By requesting, joining, agreeing to, enrolling in, signing up for, acknowledging, or otherwise consenting to receive text messages from Brunson Pumps (“Sender,” “we,” “us,” or “our”) through our messaging platform (“Platform”), you accept these Text Message Terms and Conditions (“Terms & Conditions”).
Notice Regarding Dispute Resolution
This Agreement includes provisions governing how disputes between you and Brunson Pumps are resolved. It includes an agreement to binding arbitration, which will:
- Limit your ability to bring claims against us as part of a class or representative action.
- Limit the relief you may seek to individual claims only.
Opting In
- By opting in, you authorize Brunson Pumps to use auto-dialer or non-auto-dialer technology to send text messages to the phone number associated with your opt-in request.
- You confirm that you are the subscriber to the provided phone number or the customary user of the number on a family or business plan, and that you have the authority to opt in.
- By opting in, you agree to receive marketing content and administrative messages from Brunson Pumps. Opting in is not required as a condition of purchasing any of our products or services.
- You consent to the use of an electronic record to document your opt-in.
About the Text Message Services and Opting Out
- Message and Data Rates: Standard message and data rates may apply. You must have a two-way messaging-capable device and be subscribed to a participating carrier.
- Frequency of Messages: Messages may be recurring, and frequency may vary.
- Opt-Out Instructions: To stop receiving messages, text STOP, END, CANCEL, UNSUBSCRIBE, or QUIT. You may receive a confirmation message to complete your opt-out request. Any other methods (e.g., verbal requests) are not valid means of opting out.

No mobile information will be shared with third parties/affiliates for marketing or promotional purposes. All text messaging opt-in data and consent will not be shared with any third parties.
Dispute Resolution
- Binding Arbitration: Any dispute or claim arising out of or relating to these Terms & Conditions or the Platform will be resolved by binding arbitration, rather than in court, except claims that qualify for small claims court.
- Waiver of Class Action: You and Brunson Pumps agree to resolve disputes on an individual basis, waiving the right to participate in any class or representative action.

Arbitration will follow the American Arbitration Association’s Consumer-Related Dispute Rules. Fees for claims under $10,000 will be reimbursed unless the arbitrator determines the claim is frivolous. Arbitration can occur via telephone, written submissions, or in person at a mutually agreed location.
Limitations and Restrictions
- Prohibited Content: You agree not to send or engage in sending prohibited content, including but not limited to:
- Fraudulent, defamatory, or harassing content.
- Obscene or objectionable materials.
- Unauthorized sharing of sensitive personal or health-related information.
- Violations of applicable laws or regulations.
- Age Restrictions: You must be at least 13 years old to engage with the Platform. Users between 13 and 18 years must have parental or legal guardian consent.
- Your Responsibility: If you change or discontinue the mobile number associated with your opt-in, you agree to opt-out before ending the use of your number. Failure to do so may result in liability for costs incurred by Brunson Pumps or others attempting to contact you.

The Platform is provided “as is” without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
Changes to These Terms & Conditions
We reserve the right to modify these Terms & Conditions at any time. Updates will be communicated to you via text message or other appropriate means. Continued use of the Platform after changes constitutes your acceptance of the modified terms.
